第一章 总则
Chapter 1 General Principles
第一条 为规范进口矿用产品安全标志管理工作，根据国家有关法律法规和矿用产品安全标志管理有关规定，制定本细则。
Article 1 This
rules is made accordance to the relevant law and regulation for Mining Product
Safety & Approval.
第二条 凡纳入安全标志管理目录的进口矿用产品，均应取得矿用产品安全标志，其制造商应严格执行中国相关法律法规和矿用产品安全标志管理的有关规定。
Article 2 The
manufacturer is required to have product be certified if the product is in the
mandatory approval list, the manufacturer must comply with the relevant law and
regulation in
第三条 安标国家矿用产品安全标志中心（以下简称安标国家中心）负责进口矿用产品安全标志的审核发放及监督管理工作。
Article 3
第四条 进口产品安全标志按申办类型分为有效期申办和批次申办。有效期申办又分为首次申办、延续申办和变更申办。
按有效期申办取得的产品安全标志，在规定的期限内有效；按批次申办取得的产品安全标志，仅对本批所核实的产品有效。
Article 4 There
are two ways to apply MA certification, one way called type approval, the
another way called single entry approval, type approval has been divided into 3
categories, there are application for first time, application for extension,
application for alteration respectively.
Type approval means a particular type of
product is approved for a predetermined period of time, such as valid in 5
years. Single entry approval means single products are approved each time enter
China, factory audit can be removed from this category.
第二章 申请安全标志的条件
Chapter 2 Application Qualification
第五条 进口矿用产品安全标志申请人原则上是产品的制造商。对成套或系统类产品中属安全标志独立管理的部件，其制造商不提出申请时，可由成套或系统类产品的制造商申请。制造商可委托有关机构或人员协助办理申请事宜。
Article 5 The
applicant usually is the manufacturer of application products. For the
complicated products, such as shearer, the motor is purchased from supplier,
the assembling manufacturer who producing the shear can be applicant to apply
the certification of motor instead of supplier. The manufacturer may have third
party or agency to assistance to apply the certification.
第六条 申请产品安全标志的制造商应具备以下条件：
（一）具备所在国合法资格；
（二）具有完善的质量管理体系，通过相关质量管理体系认证；
（三）具有专业化的产品生产能力、设备、技术力量，满足产品标准要求的检验设备，能够持续稳定地保证产品质量和安全性能;
（四）其他有关条件。
Article 6 The manufacturer of products
should have qualifications as follow:
1.
Has the legal qualification
in home country.
2.
Has the efficient quality management
system.
3.
Has the professional productivity,
technology, testing equipment and calibration instruments which can sustainably
guarantee the quality and safety of the products.
第七条 申请安全标志的产品应符合以下基本要求：
（一）符合中国国家标准、行业标准和矿山安全有关规定，满足矿山安全生产的需要；
（二）有完整并能有效控制产品安全性能的技术文件；
（三）有可供检验的样品。
Article 7 The
application products should meet requirements as follow:

Comply with the relevant law
and safety standards in
2. Have the technology documents which can
efficient control the safety of the products.
3. Can offer the sample to be tested.
第八条 申请产品安全标志的制造商应做出以下承诺：
（一）遵守中国相关法律法规和矿用产品安全标志管理相关规定，承担违法违规的相关责任；
（二）不侵犯他人知识产权，承担因侵权引发的相关责任；
（三）提交的申请材料真实有效，承担因提交虚假信息引发的相关责任；
（四）配合安全标志技术审查、产品检验、现场审核等相关工作,接受安全标志监督检查；
（五）严格按照安全标志审查备案的技术文件组织生产，正确加施产品安全标志标识，承担因不严格执行技术文件或擅自变更技术文件引发的相关责任；
（六）持续稳定地保证产品质量和安全性能，承担因产品质量和安全性能缺陷引发事故带来的相关责任；
（七）承担产品安全标志申办及监督管理的相关费用。
Article 8 The
manufacturer of products should make promises as follow:
1. Comply with the relevant law and
regulations in
2. Accept the consequences and responsibility
if manufacturer infringe the intellectual property rights.
3. Accept the consequences and responsibility
if the submitted documents are not real and valid.
4. Cooperate the work interrelated with
technical review, products test and factory audit, accept the supervision and
inspection after obtained the certification.
5. Ensure the production, technology, quality,
safety standards implemented in the plant conform to the documents filed in our
center. Ensure using the safety logo properly. Accept the consequences and
responsibility if manufacturer changed the technology documents without authorization.
6. Sustainably guarantee the quality and
safety of the products. Accept the consequences and responsibility if accident occurrence caused
from the product quality and safety deficiencies.
7. Accept the application fee and associated
costs from supervision and management.
第三章 首次申办
Chapter 3 Application for First Time
第九条 首次申办程序包括：申请，初审与受理，技术审查，现场评审，产品检验，终审与证书发放。
Article 9 The
procedure of Application for First time as follow: documents submitted, pre-review
and acceptance, technical review, factory audit, products test, final review
and issuing certification.
第十条 申请。制造商首次申办产品安全标志时，应向安标国家中心提交下列文件：
（一）安全标志申请书。
（二）制造商所在国的合法经营证件复印件。
（三）产品申办说明。产品申办说明应阐明产品的组成、结构、工作原理、功能、组成配置情况（防爆单元、安全制动单元、非金属材料、轻合金材料等）。申请产品与制造商已取得安全标志产品为系列产品的，还需提交差异性说明。
（四）产品技术文件。包括：
1．产品执行标准。提出符合中国国家标准或行业标准规定的产品技术条件。
2．产品图纸。
矿用隔爆型电气产品应提交反映产品隔爆结构的全部图纸及电气原理图；本质安全型产品提交涉及本安性能的全部图纸、电气原理图、PCB板图等；其他防爆类型的产品应提交产品总图、外壳结构图及所需保护装置的图纸。
机械类及其他产品提交产品总图和涉及产品安全性能的图纸。复杂产品还应提交电气原理图、液压原理图、制动系统图等。
系统或装置类产品提交构成框图及组成部件的相关图纸。
3．主要零（元）部件及重要原材料明细表。
系统或装置类产品及大型成套设备提交组成部件明细表，包括部件名称、规格型号、防爆型式、生产厂家、取得认证情况等内容。
4．产品使用说明书（操作手册）。应为原文的等条款翻译文本。
5．产品照片。应清晰反映产品的主要结构或组成。
（五）产品符合中国相关标准和矿山安全有关要求的自评价报告。
（六）产品已取得其他认证的相关资料。产品已取得所在国或国际上相关认证的，应提交认证证书及检验报告复印件，主要内容应有中译文。
（七）制造商委托有关机构或人员协助申办产品安全标志的，应出具委托授权书，明确授权范围和时限。
（八）其它申办说明材料。
以上文件须经制造商签章，并提供中译本（图纸可采用在原图上加注中文的方式），技术参数应采用国际单位制。
Article 10 Application for first time, the
manufacturer should submit the documents as follow:
1. Application form.
2. Manufacturer should have legal
qualification in home country.
3. Product description which has clear show
of the structure, working principle, function and assembling (explosion-proof unit,
safety braking units, non-metallic materials, light alloys, etc). Specify the
differences if the product to be applied is the series category as certified
product.
4. Technical documents as follow：

standards should meet the relevant law and regulation in

drawing
Subassembly
drawings of flameproof enclosure, schematics must be submitted if the application product is Ex type
electrical apparatus. Internal wiring diagrams, printed circuit board artwork
and IS layout drawings if the application product is IS type. Overall system, enclosure
structure drawing and protection device diagram must be submitted if the
application product belongs to other Ex type.
Mechanical
drawing and components drawings must be submitted if the application product is
mechanical, hydraulic drawing, brake diagram and schematics must be submitted
if the application product is complicated.
Block
diagram, assembly drawing and subassembly drawings must be submitted if the
application product is system or system class.
（3)
Parts
list and bill of material must be submitted if the application product is
system or system class. The list including component name, model, Ex type,
manufacturer and certified status.
（4)
Product
operation manual, Chinese version must be enclosed.
（5)
Product
photos which show the structure and main components clearly.
5. Self-assessment report declares the
products comply with the relevant standards and regulation in
6. The certification already obtained (such
as MSHA and ATEX ect) and test reports must be submitted.
7. The authorization letter (including
authorized products and authorization expire date) must be offered if
manufacturer have third party or agency to assistance to apply the certification.
8. The other application documents.
Note: All documents mentioned above should
be offered by Manufacturer with stamp, and Chinese translated versions also
need to be provided (only drawings can have Chinese notes or reference signs,
the rests need to be translated to Chinese word for word). International
System of Units applies to all technical parameters.
第十一条 初审与受理。安标国家中心对申请材料进行初审。初审合格的，制定申办方案，签订申办合同，发出受理通知书；初审不合格的，不予受理。初审工作在收到申请材料之日起20个工作日内完成。
Article 11 Preliminary
review and acceptance is conducted by MA center. The contract will be
signed, test plan and acceptance notification will be offered if passing preliminary review,
manufacturer must reprepare documents and resubmit in 20 working days from the
date of failure in preliminary review.
第十二条 技术审查。安标国家中心组织实施技术审查。
审查依据是中国相关标准和矿山安全有关规定，审查重点是产品安全性能。电气类产品，主要审查防爆性能、安全防护与保护性能、安全使用性能等；机械类产品，主要审查机械安全性能、安全防护与安全使用性能等；非金属类产品，主要审查阻燃及抗静电性能等。
审查的技术文件包括产品执行标准、图纸、主要零（元）部件及重要原材料明细表等。对技术复杂、需要结合实物或检验后方能完成技术审查的产品，技术审查可与产品检验工作同步进行。
技术审查应自收到审查所需的完整技术文件之日起45个工作日内完成，对需经检验后方能完成全部技术审查的产品，技术审查时限可适当放宽。审查合格的，对技术文件备案；审查不合格的，通知制造商进行整改。整改工作应自通知书发出之日起180日内完成，逾期未完成或整改后仍不合格的，终止本次申办。
Article 12 Technical
review is conducted by MA center. Technical review is conducted based on the
relevant standards and regulations in
Internal wiring diagrams, printed circuit
board artwork, IS layout drawings, schematics, parts list, bill of material,
assembly & subassembly drawings, products standards will be reviewed in the
stage of technical review. The stage of technical review and stage of product
test can be carried out simultaneously if the application product needed to be
witness checked due to complexity structure.
The stage of technical review will be
completed within 45 working days from the date of acceptance; this time limit
could be extended if the application product is complicated. The application
documents will be filed in our center if passing the stage of technical review.
Manufacturer has to modify the documents and resubmit within 180 working days
from the date of failure in stage of technical review. The application will be
terminated if failure in resubmit documents.
第十三条 现场评审。安标国家中心组织评审组实施现场评审工作。评审组由在安标国家中心注册的评审员及聘请的技术专家组成。
现场评审依据现场评审规范或相关产品评审准则进行。主要审核主体资格、技术文件、生产及计量检验设备、关键环节控制、质量管理体系及其运行情况等。
现场评审工作时间一般为2～3天。评审结论在评审现场宣布，提出的不符合项须经制造商确认。现场评审结论分合格、整改后合格和不合格三种。
评审结论为整改后合格的，制造商应在现场评审结束之日起90日内应完成不符合项的整改，逾期未完成整改或整改后仍不合格的，终止本次申办。评审结论为不合格的，安标国家中心组织进行复评审。
为保证产品安全性能，必要时可对安全标志主要受控零（元）部件供应商进行延伸评审。
Article 13 Factory
audit is conducted by MA center, audit team will be organized and this team
will conduct on-site assessment in factory. The team members are selected from
the registered professional experts.
The factory audit is conducted accordance
to the relevant rules and regulations. The manufacturer qualification,
technical documents, production, calibration instruments and quality management
system will be reviewed in the stage of factory audit.
The factory audit usually lasts 2 or 3
working days. The results of factory audit will be presented in the field; the
failed items will be confirmed by manufacturer. 3 kinds of results of factory
audit are called Passing, Modification and Failure respectively.
The failed items have to be modified
within 90 working days from the date of results presenting if the Modification
is required, this application will be terminated if the modification is overdue
or the result of modified items are failed again. Reaudit will be conducted by
MA center if the result is Failure.
The supplier of subassembly product may
need to be conducted factory audit if the subassembly product is considered
safety affection.
第十四条 产品检验。产品检验工作由安标国家中心委托国家安全监管总局授权的安全生产检测检验机构实施。
检验项目原则上为中国相关标准规定的涉及产品安全性能的项目。对重要安全产品，应为标准规定的型式检验项目；对大型设备，某些项目检验可能破坏产品结构时，可直接引用国外检测检验机构对该产品依据满足中国标准规定的相关标准出具的检验结果；对曾取得批次安全标志的产品，原则上可参考或引用批次检验结果。
检验工作原则上在中国境内相关检测检验机构实施，特殊情况下可在制造现场或产品使用现场进行。
检验机构原则上自收到样品之日起45个工作日内完成检验工作。对需在产品制造现场检验的产品，检验工作可在现场评审工作结束后实施。检验不合格的，制造商应自检验不合格通知发出之日起180日内完成整改，逾期未完成或整改后仍不合格的，终止本次申办。
Article 14 Product
test is conducted by test body which authorized from MA center, test body are
accredited by state administration of work safety.
Test
items are focused on the safety performance which referenced back to the
relevant Chinese standards and regulations. Type proof test items will be
conducted if the application product is safety affection. For big scale
equipment, the test report from test body overseas can be accepted in order to avoid
destructive test, such as roof support. For application products obtained the single
entry certification, the previous single entry approval test report can be
referenced or direct accepted.
Product test are usually conducted in
The stage
of product test usually will be completed within 45 working day from the date
of sample arriving. The product test is conducted after the stage of factory
audit. The failed items
have to be modified within 180 working days from the date of results presenting
if the Modification is required, this application will be terminated if the
modification is overdue or the result of modified items are failed again.
第十五条 终审与证书发放。安标国家中心组织实施终审。终审主要对申办过程中的相关文件进行综合评定。终审在5个工作日内完成。
终审合格的，发放有效期为5年的安全标志证书。对成套或系统类产品中属安全标志独立管理的部件，单独发放安全标志证书，证书中注明制造商信息。
Article 15 Final
review and issuing approval is conducted by MA center, final review is general
check the all stages and procedure before issuing approval, it will be
completed within 5 working days.
5 years effective certification will be
issued after final review if application product is type approval. The product
or component from system or system class will be issued the certification separately;
manufacturer information will be indicated in the certification.
第十六条 安标国家中心对安全标志获证信息予以公告。
Article 16
The approval products will be public in MA website.
第十七条 取得安全标志的矿用产品，制造商应按规定在产品或最小包装上加施安全标志标识。矿用产品安全标志标识的制作和使用应执行AQ1043《矿用产品安全标志标识》的相关规定。
Article 17 The
MA/KA logo has to be applied into products or packing by manufacturer according
to the AQ1043《Mining Products Safety Label》
第四章 变更申办
Chapter 4
Application for Alteration
第十八条 已取得有效期安全标志的产品，因制造商主体资格、生产条件、技术文件等发生变化时，应向安标国家中心提出申请，经履行相关程序后，变更安全标志。
基本程序包括申请、初审、技术审查、现场评审、产品检验、综合审查与变更安全标志证书。具体程序根据产品变更情况确定。
Article 18 The
manufacturer has to apply the alteration to the certified type approved product
if changes occurrence in manufacturer qualification, production condition,
technical document and other facts.
The procedure of application for
alteration as follow: documents submitted, pre-review and acceptance, technical
review, factory audit, products test, final review and changing certification.
The details of procedure is based on the content of changes.
第十九条 申请。制造商提出变更申请时，应根据变更具体情况提交相应材料，主要包括：
（一）变更申请书。
（二）相关文件。属制造商主体资格变更的，应提交变更证明材料，并附情况说明；属产品生产条件变化的，应提交变更前后的情况说明，并分析其对产品质量和安全性能的影响；属产品技术文件发生变化的，应提交变更后的技术文件。
（三）其它文件。
Article 19 Application for alternation, the manufacturer should submit
the documents as follow:
（1) Application form for
alternation.
（2) For the changes in legal
qualification, manufacturer should submit the evidences of changes and enclose
the changes specification. For the changes in production condition, manufacturer
should submit the changes description (before and after) and analyze the
changing effects to the products quality and safety performance. For the changes
in technology documents, manufacturer should submit the changed documents.
（3) The other application documents.
第二十条 初审。安标国家中心对变更申请材料进行初审，合格的予以受理，与制造商签订合同。涉及生产条件或产品变更时，对变更情况进行评估，确定申办方案。
初审工作在收到申请材料之日起20个工作日内完成。
Article 20
Preliminary review. The contract will be signed in this stage, test plan and acceptance
notification will be
offered if passing preliminary review. MA center will draft the test plan after
evaluating the changes in production condition and products.
Preliminary review will be completed
within 20 working days from the date of receiving application.
第二十一条 技术审查。对与变更相关的技术文件进行差异性审查，重点是变更所涉及的安全性能。技术审查完成时限根据产品变更情况确定，最长不超过同类产品首次申办审查的工作时限。
Article 21 Technical
review. Discrepancy review will be carried out to the changed documents in the stage,
it focuses on the safety performance of the products. The time frame of the
stage is based on the condition of changes of product, however, this time frame
will not exceed the time taken from series type in Application for First Time.
第二十二条 现场评审。对需进行现场评审的，安标国家中心组织评审组进行现场检查和考核。
Article 22
Factory audit is conducted by audit team which organized by MA center if audit
is necessary.
第二十三条 产品检验。对需进行检验的产品，主要进行与变更相关联的安全性能项目检验。检验工作时限根据产品变更情况确定，但原则上最长不超过自检验机构受到样品之日起45个工作日。
Article 23 Products test. The safety items and
changing items will be carried out if products test is necessary, the time
limit of this stage depends on the changing content of product, however, it
will not exceed the 45 working days from the date of sample receiving.
第二十四条 终审与变更安全标志。经相关材料的完整性、准确性、一致性的终审，符合变更安全标志相关要求的，变更安全标志，换发安全标志证书，安全标志有效期与变更前相同。
Article
24 Final review and approval to changing. MA
center will reissue a type apprvoal certification after passing final review,
and the expiration date of the updated certification will not be changed.
第五章 延续申办
Chapter 5
Application for Extension
第二十五条 已取得有效期安全标志的产品，有效期届满需要延续安全标志时，制造商应在产品安全标志有效期届满前3～6个月向安标国家中心提出延续申请，经履行相关程序后延续安全标志。
程序包括：申请、技术审查、现场评审、产品检验、终审与延续安全标志等。
Article 25 The
manufacturer has to apply the extension of approval product if the certified type
approved product is going to be expired; manufacturer has to submit the extension
application documents in 3-6 months advanced before it is expired.
The procedure of the application for
extension as follow: application, technical review, factory audit, product test,
final review and extension approval.
第二十六条 申请。制造商应提交延续申请书。
Article 26 Application.
The manufacturer should submit application form for extension.
第二十七条 初审。安标国家中心对延续申请进行初审，合格的予以受理，与制造商签订合同。初审工作在收到申请材料之日起5个工作日内完成。
Article 26 Preliminary
review. Preliminary review is conducted by MA center. The contract will be
signed, test plan and acceptance notification will be offered if passing preliminary
review.
The pre-review procedure will be completed
within 5 working days form the date of receiving application documents.
第二十八条 技术审查。重点审查产品执行标准的有效性。
技术审查自受理之日起5个工作日内完成。特殊情况下，需委托有关技术机构进行审查时，应在20个工作日内完成。因中国相关标准变化需对技术文件整改的，制造商应自收到通知书之日起30日内完成。逾期未完成整改或整改后仍不合格的，终止本次申办。
Article 27 Technical
review. This stage is focused on the effectiveness of standards implementation.
The procedure of technical review will be
completed within 5 working days from the date of application documents acceptance.
Application documents will be evaluated by the authorized test body within 20
working days under specific circumstance. The manufacturer should change the
technical document within 30 working days from the date of receiving notice if
Chinese standards updated. The application will be terminated if discrepancies
are not resolved or overdue.
第二十九条 现场评审。产品延续安全标志时原则上应进行现场评审，重点评审制造商是否按安全标志审核发放要求组织生产。
Article 29 Factory audit generally will be conducted in the
stage of extension if the audit is necessary. Whether the production in the
plant meets the requirement is the point of this audit.
第三十条 产品检验。延续安全标志时原则上应进行产品检验，检验项目为相关标准和安全标志检验规范确定的涉及产品安全性能的项目。
大型设备延续安全标志时，提供样品有困难的，可先期延续安全标志，待延续后的产品首批进入中国境内时，再实施检验。
Article 30 Product test generally will be conducted in the
stage of extension. The test items will focus on the safety performance of the
products and certain relevant assessments.
Manufacturer should
apply the extension in advance and test will be arranged until first batch
shipment to China if the large scale equipment sample is difficulty to offer for
testing under this part.
第三十一条 终审与延续安全标志。经相关材料的完整性、准确性、一致性的综合审查，符合延续安全标志相关要求的，延续一个有效期的安全标志。
Article 31
Final review and extension of
approval.
MA center will issue a type approval of extension certification after passing
final review.
第六章 批次申办
Chapter 6
Application for Single Product Approval
第三十二条 程序包括：申请、初审与受理、技术审查、产品检验、终审与证书发放。其中，申请、初审与受理、技术审查的相关要求与首次申办程序中的一致。
Article 32 Application for Single Product Approval. The
procedure of Application for Single Product Approval as follow: documents
submitted, pre-review and acceptance, technical review, products test, final
review and issuing certification. The requirements of document submitted, pre-review
and acceptance, technical review is same as Application for First Time.
第三十三条 产品检验。制造商应在产品进入中国境内且具备检验条件后，向安标国家中心提交检验申请；安标国家中心在收到申请后5个工作日内安排检验任务。相关检测检验机构原则上应在产品具备检验条件之日起45个工作日内完成产品检验工作，出具检验报告。检验不合格的，终止本批次申办。
Article 33 Products test. Manufacturer submits the application documents after the product has shipped to China and ready for the test. MA center will arrange the test within 5 working days from the date of receiving application documents. The test will be completed and the test report will be offered by the authorized test body within 45 working days from the date of sample ready. This application will be terminated if test failed.
第三十四条 终审与证书发放。经相关材料的完整性、准确性、一致性的综合审查，符合相关要求的，发放附有产品制造编号的安全标志证书。
Article 34 Final
review and issuing approval. MA center will issue a single product approval certification
with Product Serial Number after passing final review.
第三十五条 对已取得批次安全标志的产品，制造商再次申请其安全标志时，若产品技术文件未发生变更，且制造商做出相关承诺时，可免于技术审查，在取得安全标志后两年内免产品检验，仅进行样品的一致性核实。
Article 35 Application for the products already hold
the single product approval certifcation will be exempted from technical review
if the technical documents is not changed with the promise from manufacturer. Sample
will only be conformity verified if manufacturer applies same single entry
approval application which does not exceeds 2 years after first single entry
approval.
第七章 责任与义务
Chapter 7 Duties
and Responsibilities
第三十六条 产品的责任主体是制造商，制造商应严格执行中国相关法律法规和安全标志管理有关规定。
Article 36 Manufacturer
should take the full responsibilities of the application products. The relevant
Chinese law and regulations must be strictly implemented by manufacturer.
第三十七条 对产品相关国家标准、行业标准未予明确规定的性能，以及依据安全标志管理有关规定，在安全标志审核中不予涉及的产品质量和使用性能由制造商保证。
Article 37 Manufacturer
should take the responsibilities to assure the product’s quality and
performance even though relevant standards and regulation is lack of certain
requirements.
第三十八条 安标国家中心及承担技术审查的技术机构、承担委托检验任务的检验机构，制定安全标志档案管理规定，任何单位或个人不得擅自借阅备案的技术文件。
Article 38 MA
center and authorized test body has the right to file and manage the technical
documents, neither the corporations nor individuals will be allowed to borrow
the filed documents.
第三十九条 安标国家中心及承担技术审查的技术机构、承担委托检验任务的检验机构，保守制造商的技术秘密，不侵犯制造商的知识产权，不从事所审查领域产品的研发、生产。
Article 39 MA
center and test bodier take the responsibilities to keep the technology secrets
for manufacturers and keep the intellectual property rights not be infringed,
MA center and the authorized test body will not engage in the field of the approval
products research and development.
第四十条 制造商应按安全标志审查备案的技术文件和评审通过的生产条件组织生产，承担违规引发的相关责任。
Article 40 Manufacturers
is obliged to assure the products manufactured conform to the approved
technology documents filed in our center. Manufacturers is obliged to accept
the consequences if manufacturers against this article.
